Beta Test Agreement

This Beta Test Agreement ("Agreement") governs your participation in the Sainted Word Records Early Access Program ("Program"). By accessing or using the pre-release software provided through the Program, you agree to be bound by this Agreement.
Important: This software is pre-release and provided for testing and evaluation purposes only. It is not for production use.
1. Limited License
Subject to this Agreement, Sainted Word Records grants you a limited, non-exclusive, non-transferable, revocable license to:
- Access and use the pre-release software ("Software") for the sole purpose of testing and evaluating its functionality
- Provide feedback, suggestions, and ideas about the Software
You may not use the Software for any commercial purpose, production work, or redistribution.
2. "As-Is" Disclaimer
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. SAINTED WORD RECORDS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
You acknowledge that the Software may contain bugs, errors, or other issues, and that your use of the Software is at your own risk.
3. Liability Cap
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SAINTED WORD RECORDS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO THIS AGREEMENT OR YOUR PARTICIPATION IN THE PROGRAM.
SAINTED WORD RECORDS'S TOTAL LIABILITY UNDER THIS AGREEMENT SHALL NOT EXCEED $100 USD.
4. Confidentiality
You agree to keep confidential and not disclose to any third party:
- Any non-public information about the Software, including but not limited to its features, functionality, design, and roadmap
- Any information marked as confidential or that reasonably should be understood to be confidential
- The existence and terms of this Agreement
This obligation survives termination of this Agreement.
5. Feedback Clause
You agree that any feedback, suggestions, ideas, enhancement requests, or other input you provide regarding the Software ("Feedback") shall be the sole property of Sainted Word Records. You hereby irrevocably assign to Sainted Word Records all right, title, and interest in and to such Feedback, without compensation.
Sainted Word Records shall be free to use, disclose, reproduce, license, and otherwise exploit the Feedback without obligation or restriction.
6. Term & Termination
This Agreement remains in effect until terminated by either party.
Your termination: You may stop participating in the Program at any time by providing written notice to Sainted Word Records and ceasing all use of the Software.
Our termination: Sainted Word Records may terminate your participation in the Program at any time, with or without cause, by providing notice to you. Upon termination, you must immediately cease all use of the Software and destroy any copies in your possession.
Sainted Word Records reserves the right to modify, suspend, or discontinue the Program at any time without notice.
7. Intellectual Property
The Software and all intellectual property rights therein are and shall remain the exclusive property of Sainted Word Records. This Agreement does not grant you any ownership rights in the Software.
8. Data Collection
By participating in the Program, you acknowledge that Sainted Word Records may collect usage data, crash reports, and other technical information to improve the Software. This collection is subject to our Privacy Policy.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Sainted Word Records operates, without regard to its conflict of law provisions.
10. Entire Agreement
This Agreement constitutes the entire agreement between you and Sainted Word Records regarding the Program and supersedes all prior agreements and understandings.
